Permitted development and Article 4(2) Directions
Even in conservation areas many changes are ‘permitted development’ (that is work which can be carried out without planning permission).These changes include replacement of doors and windows, demolition of boundary walls, demolition of chimneys etc. Cumulatively these changes can have a marked effect on the appearance of a conservation area. In consequence local authorities can introduce special controls called Article 4(2) Directions. These remove ‘permitted development’ rights so planning permission is required for these works so that sympathetic changes can be encouraged.
Article 4(2) Directions only apply to dwelling houses. Changes to other properties such as flats, shops and offices require planning permission if they materially affect the appearance of the building.
