Planning Appeals – Changes to the Appeal Service
New changes came in to force on 6th April 2009
Further information from the Planning Inspectorate
If you want to appeal against refusals or any grant of planning permission, consent, agreement or approval which is granted subject to conditions then you must do so within 6 months of the date of the notice of the decision.
Objectors do not have the right of appeal.
If planning permission is refused or granted subject to conditions, the applicant can appeal to the Secretary of State for Communities and Local Government. We will notify all those that have commented on the application that an appeal has been made.
The appeal can be dealt with by one of three methods:
- written representation
- informal hearing or
- public inquiry.
Written representation
If the proposal is a householder application and dealt with by the written representation procedure, any comments made on the original application will be forwarded to the Planning Inspector who will be appointed by the Secretary of State to consider the appeal. You will not be able to make further comment on a householder appeal.
If the appeal is not a householder application you will be able to make further comment to the Planning Inspector.
Informal hearing or public inquiry
If there is a public inquiry or informal hearing both objectors and supporters have the right to speak.
Householder Appeal Service
Householder applications made on or after 6 April will be dealt with via the Householder Appeals Service (HAS).
Definition of a householder application
For householder appeals, the time limit for an applicant to submit an appeal against refusal of planning permission will be 12 weeks from the date of the notice of the decision.
